Certificate of conformity of the Customs Union - CoC

The Customs Union, which began in October 2007, represents a mutually beneficial partnership between the several states that regularly trade with each other. The certificate of the customs union is a permissive document for goods, raw materials, and equipment inside the union. The advantage of this association between Russia, Kazakhstan, Belarus, Kyrgyzstan and Armenia, is a significant facilitation of trade activity through the reduction of or complete elimination of customs duties.

The management of the Customs Union is carried out by an intergovernmental commission, which includes representatives of all the member countries. According to these agreements, this body conducts its business from the capital of Russia.

What is the certificate of the Customs Union?

In order to ensure proper control over the quality of goods moving between the member states of the Customs Union, a modern system for their certification has been developed, determining compliance with all applicable standards.

Manufacturing companies for products sold within the CU, after passing this procedure, receive a certificate of the Customs Union.

This document gives them the right to freely trade with any of the countries within the association on the most favorable terms for themselves.

Important: The Certificate of Conformity of the Technical Regulations of the Customs Union can be formalized both for goods produced by the countries of the Customs Union and of foreign manufacturers. The requirements for foreign products and for products made in the CU are the same, and certification schemes also coincide.

Certificates of the Customs Union: confirmation of conformity of products to GOST or technical regulations

The main purpose for the introduction of certification of the Customs Union is to ensure the conformity of goods to both state standards (GOST) and the technical regulations, the following of which have already been adopted by all Customs Union partners:

  • Regulations that guarantee the safety of packaging of certain goods, as well as a variety of products for children and adolescents;
  • Technical regulations on the safety of production equipment and machines and devices used in production where there is a risk of fire or explosion, as well as apparatuses operating on gas fuel;
  • Technical regulations on the safety of food products – grain, oil and fat products, flavors, stabilizers and other chemical food additives;
  • Regulations on the safety of chemical products, cosmetics and perfumes.

All of the above technical regulations entered into force on March 15, 2015. Before this date, the were transitional provisions that allowed trade without a certificate of compliance for the Customs Union, and the use of national standards and regulatory documents. Today it is not possible – every participant of the CU market is required to pass the certification procedure if the goods produced or sold by it are found on the corresponding list.

Who should carry out the registration of the certificate of conformity of the Customs Union?

The certificate of conformity for the Customs Union is necessary, first of all, for producers of various products. For this reason, a trading company or a manufacturing company needs to perform a few simple steps:

  • Check whether the product being sold is included in the Unified List of goods subject to certification;
  • Pass the procedure for issuing a document confirming compliance with GOST or technical regulations;
  • Get a certificate that gives a number of benefits – Including preferential terms for its transportation and distribution within the countries of the Customs Union.

How to get the certificate of conformity of the Customs Union?

The procedure for issuing the certificate can be carried out according to the following schemes:

  • Depending on how many products a manufacturer imports into a particular country of the Customs Union, the document can be obtained both for serially produced products and for each lot separately;
  • During the process of certificate registration, certain groups of goods are subject to mandatory testing in specially accredited organizations;
  • An application for registration of a certificate can be issued not only by the manufacturer of the product, but also by its seller, who will sell the goods in his country, which is part of the Customs Union.

The Customs Union Certificate is unified for all states that are members of the economic union. To obtain a document confirming the quality of products, Russian manufacturers must provide the requisites of the enterprise, GOST or technical conditions in accordance with which the goods are produced and constituent documents of the legal entity.

Foreign producers will need a slightly larger package of documents, which, in addition to all of the above, should include:

  • Name of product;
  • Detailed product description and manual for its operation;
  • HS Code (Custom Code);
  • Address of the manufacturer;
  • Contract for the supply of goods, concluded between the manufacturer and the seller/distributor.

Registration of the certificate of conformity of the Customs Union takes place in our body for product certification, conducted by one of our experts. Before drawing up the document, our customer receives a preliminary certificate layout for reconciliation and verification of all data for errors and reliability. After confirmation by the customer that all the data is correct – we issue the certificate and add it to the register.

Terms for which the certificate of the Customs Union is drawn up

The maximum validity period of the certificate of compliance of the Customs Union is 5 years. However each manufacturer is free to choose, within what time the document received will operate. The vast majority of companies use this opportunity in two main ways:

  • Draw up a certificate of the Customs Union for all five years – this makes it possible, at minimal cost, to obtain the right to free trade on the territory of all CU states;
  • As a start – buy a certificate for a year, and then reissue it. This approach allows you to check the terms of trade in selected countries, assess the demand for goods, and develop the most effective way for the company to further develop the market. In addition, in this way, you will incur a minimum of losses if the document is not needed for more than 12 months.

Liability provided for trading without a certificate of conformity

The current legislation provides for administrative liability for violation of the rules of trade for the sale of goods without a certificate of the Customs Union. But the penalties are only part of the punishment. In addition, the violator simply will not be able to cross the border of the vehicle with the goods that did not pass all necessary checks for compliance with GOSTs and technical regulations. Also, sales of these products will be substantially limited, which could lead to significant losses.
